Kenya: absence of interpreter can nullify death sentence
|
Nairobi, Kenya [DN (registration required)]: In yet another case, Kiyato versus Republic (1982-88) KAR 418, Kiyato had been convicted of robbery with violence and sentenced to death. He appealed to the Court of Appeal, which found that the trial court had failed to provide him with an interpreter. This was in contravention of his right to a fair trial, provided in section 77(2) (f) of the Constitution. The nature and strength of the evidence against Kiyato did not matter in this case.
